This online health plan comparison tool ("Tool"), is licensed by the Health Benefit Exchange Authority ("HBX") from Consumers' CHECKBOOK, a division of the Center for the Study of Services. Consumers' CHECKBOOK, the Center for the Study of Services ("CSS") and HBX may be referred to collectively in this document as "we/us/our". This agreement states the Terms and Conditions under which you may use this Tool ("Terms of Use"). By accessing or using this Tool, you agree to be bound by these Terms of Use.

Purpose

The content contained within this Tool and its associated web pages are presented by Consumers' CHECKBOOK with the intent of providing public service information on consumer health plans and health-related topics. The health care information and advice provided by this Tool is not intended be a substitute for professional medical or financial advice. Always seek the advice of your physician or other qualified healthcare provider prior to starting any new treatment or if you have questions regarding a medical condition. Intellectual Property Rights and Limitations on Use

This Tool is the intellectual property of Consumers' CHECKBOOK. Data on plan benefits and cost rates and certain trademarks, logos, and color formats, that are used to make the Tool operational, are the intellectual property of HBX and other companies. By using this Tool, you agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast, print or circulate any of the information received from this Tool to anyone without the express prior written consent of its owner(s). All information presented in this Tool is intended solely for your personal, non-commercial use. This Tool, and any of its data, listings or other constituent elements may not be downloaded, scraped, harvested, republished, resold, or duplicated, in whole or in part, for commercial purposes or for purposes of compiling mailing lists or any other lists. The use of this Tool to establish independent data files or compendiums of statistical information is prohibited. HBX and Consumers' CHECKBOOK/CSS reserve the right to limit, restrict, or terminate access to this Tool at their discretion, without notice.

HBX AND Consumers' CHECKBOOK/CSS EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN RELATION TO THE TOOL OR ANY TRANSACTION THAT MAY BE CONDUCTED ON OR THROUGH USE OF THE TOOL, INCLUDING ANY WARRANTY OF COMPATIBILITY, SECURITY, NON-INFRINGEMENT, MERCHANTIBILITY, OR FITNESS FOR PARTICULAR PURPOSE.

No Liability

Consumers' CHECKBOOK/CSS and HBX shall not be liable to you or anyone else for any loss or injury caused in whole or in part by their negligence in, or by contingencies beyond their control in, procuring, compiling, interpreting, reporting, or delivering this Tool and any information contained in this Tool. In no event will Consumers' CHECKBOOK/CSS or HBX be liable to you or anyone else for any decision made or action taken by you in reliance on such information. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Consumers' CHECKBOOK/CSS AND HBX SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER including, without limitation, incidental, consequential, or punitive damages, lost profits, the cost of procuring a substitute service or the cost of a lost opportunity resulting or arising from your use of this Tool or your inability to use this Tool, whether based on a breach of contract claim, tort or any other legal theory, even if we have been advised of the possibility of such loss or damage or if such loss or damage could have been reasonably foreseen.

Indemnification

You agree to indemnify, defend and hold harmless Consumers' CHECKBOOK and HBX against any claims, actions, suits, damages, costs, or expenses (including attorneys' fees and expenses) arising out of or relating to i) your unlawful or negligent use of the Tool; or ii) your alleged breach of these Terms of Use.

Consumers' CHECKBOOK Privacy Policies

Cookies

Consumers' CHECKBOOK uses "cookies" to maintain your access privileges during an online session. We evaluate site usage by analyzing user information in the aggregate, in a way that does not identify any individual user. Occasionally, we may identify an individual user's activity when such user is logged into his or her HBX account and is having difficulty navigating the Tool, but only for the purpose of restoring such user's access issue. Please note that you must accept cookies in order to use this Tool. The aggregate information we collect is never used by third parties for marketing or tracking purposes.

Information Logging and Storage

Consumers' CHECKBOOK uses Google Analytics and/or Microsoft Clarity to collect and store the minimum amount of information from the Tool's website usage that is necessary to provide a user-friendly experience, improve this Tool's effectiveness, and analyze utilization and resource requirements. Google Analytics and Microsoft Clarity do not collect, access, use, or store any individual user's personally identifiable data.
